Rules on the purchase and sale of goods

  1. General provisions

1.1. These E-shop Rules (hereinafter referred to as the “Rules”) are a legally binding document for the Buyer and the Seller (hereinafter referred to as the “Seller”), setting out the rights and obligations of the Parties.

1.2. The Seller reserves the right to change, amend or supplement these Terms and Conditions at any time. The Buyer shall be informed of any changes to the Terms and Conditions on the website of the e-shop.

2. Conclusion of the sale and purchase agreement

2.1. The contract of sale and purchase between the Buyer and the Seller shall be deemed to have been concluded when the Buyer forms and submits an order for the goods in the online shop, having first read and understood these Rules.

3. Seller’s rights

3.1. In the event of serious circumstances, the Seller may temporarily or completely suspend the operation of the online shop without prior notice to the Buyer.

3.2. If the Buyer attempts to undermine the operation, stability and security of the online shop or violates his/her obligations, the Seller shall have the right to restrict or suspend the Buyer’s access to the online shop without notice.

4. Obligations of the Seller

4.1. The Seller undertakes to make available the services of the e-shop, the conditions of operation of which are set out in these Terms and Conditions.

4.2. The Seller undertakes to deliver the goods purchased by the Buyer by the delivery method chosen by the Buyer, in accordance with the terms and conditions set out in these Terms and Conditions of Sale.

4.3. Where, due to unforeseen circumstances, the Seller is unable to deliver the goods ordered in the online shop, the Seller shall have the right to terminate the Purchase and Sale Agreement after informing the Buyer.
The Seller may offer a similar product.
If the Buyer refuses, the Seller undertakes to refund the money paid within 3 working days.

4.4. If the Buyer has exercised the option set out in 5.2.
5.2.2, the Seller undertakes to refund the money paid to the Buyer within 5 (five) working days from the date of receipt of the returned goods.

4.5. The Seller may not refund the amount paid by the Buyer until the Goods have been returned to the Seller or until the Buyer has provided proof that the Goods have been dispatched to the Seller, whichever is the earlier.

  1. Buyer’s rights

5.1. The Buyer shall be entitled to purchase goods in the Online Shop in accordance with these Terms and Conditions.

5.2. The Buyer shall have the right to withdraw from the contract of sale and purchase of goods concluded in the online shop by notifying the Seller in writing no later than 14 (fourteen) calendar days from the date of delivery of goods.

5.3. The Buyer may only exercise the Buyer’s right referred to in clause 5.2 if the goods have not been damaged or substantially altered in appearance, nor have been used.

6. Obligations of the buyer

6.1. The Buyer is obliged to pay for the goods purchased and to accept them in accordance with these Conditions.

6.2. If the Buyer refuses to accept the goods at the time of delivery without good reason, the Buyer shall be obliged to pay the costs of returning the goods at the Seller’s request.

6.3. At the time of delivery of the Goods to the Buyer, the Buyer shall inspect the condition of the consignment and the Goods(s) together with the Seller or the person delivering the consignment.

6.4. By using the online shop, the Buyer confirms that he/she accepts these Terms and Conditions of Sale and must comply with them.

7. Commodity prices

7.1. The prices of goods in the online shop are quoted in euros.
Prices are inclusive of VAT.
Once the order has been confirmed, delivery charges, if any, shall be added to the total amount of the goods.

  1. Ordering and payment of goods

8.1. When visiting the online shop, the Customer selects the goods he/she likes and puts them in the shopping cart.
After the shopping cart has been created, the Buyer shall enter the personal data necessary for the execution of the order: his/her name, surname, the address to which the goods will be delivered, telephone number and any additional information that may be relevant for the delivery of the goods ordered.

8.2.The Buyer acknowledges that he/she has read these Rules and confirms the order.

8.3. Payment can be made using Swed, Seb, Luminor, Citadele, Šiaulių Bankas electronic banking services and Visa / MasterCard payment cards.
Payments can be made in Euro currency.
Payments are processed using the MakeCommerce.lt payment platform.

9. Delivery of goods

9.1. When ordering goods, the Buyer must specify the exact delivery address.

9.2. The Buyer is obliged to accept the goods himself.
If the Buyer is unable to take delivery of the goods himself but the goods are delivered to the address specified by the Buyer, the Buyer shall not be entitled to make any claim in respect of the delivery of the goods to the wrong person.

9.3. The Seller shall deliver the Goods to the Buyer in accordance with the terms set out in the descriptions of the Goods.

9.4. The characteristics of all goods sold shall be set out in the description attached to each good.
The Seller shall not be liable for the fact that the colour, shape or other parameters of the goods in the online shop may not correspond to the actual size, shape and colour of the goods due to the characteristics of the monitor used by the Buyer.

9.5. In the event of the Buyer’s withdrawal from the contract of sale of the goods, the Buyer shall be refunded all sums paid by the Buyer, including the delivery costs paid by the Buyer.

  1. Return of goods

10.1. Goods of good quality may be returned within 14 days of receipt.
The defects of the goods sold in poor quality shall be eliminated, the poor quality goods shall be replaced and returned in accordance with the provisions of the Civil Code of the Republic of Lithuania.

10.2. The following conditions must be observed when returning goods:

10.2.1. The returned goods must be in their original packaging in good condition (this point does not apply in the case of the return of low-quality goods);

10.2.2. The goods must be undamaged by the Buyer;

10.2.3. The Goods must be unused and in good condition: no damaged labels, no peeled protective films, etc.
(this does not apply in the case of returns of low-quality goods);

10.2.4. The returned goods must be in the same condition as when received by the Buyer (this clause does not apply in the case of returns of defective goods);

10.2.5. The Seller shall have the right to refuse to accept the Buyer’s returned goods if the conditions for the return of goods have not been complied with;

10.2.6. The return of goods shall be made in the manner prescribed by the Seller within 14 (fourteen) days from the date of receipt of the goods (this clause does not apply in the case of low-quality goods, in which case the return of goods shall be made within the statutory warranty period);

10.3. The return and replacement of goods of satisfactory quality shall be carried out in accordance with Article 6.22810(1) of the Civil Code;

10.4. Money paid for goods accepted by the Buyer but subsequently rejected shall be refunded to the Buyer’s account no later than within 5 (five) days from the date of the return of the goods to the Seller, unless the Seller and the Buyer agree otherwise.

11. Final provisions

11.1. These Terms and Conditions are made in accordance with the legislation of the Republic of Lithuania.

11.2. These Terms and Conditions and the relationship between the Parties hereto shall be governed by and construed in accordance with the laws of the Republic of Lithuania.

11.3. All disagreements arising out of the performance of these Terms and Conditions shall be settled by negotiation.
In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.

11.4. The Parties shall be excused from the performance of their obligations under these Terms and Conditions if such performance is prevented by unforeseen circumstances beyond the control of the Parties (Force Major).
